Arrived as Ensign with New South Wales Corps per "Royal Admiral", 1800. In 1806 and 1809 he was Commandant at Newcastle and 1819-24 Commandant at Bathurst; in 1813 he joined Blaxland and Wentworth in the first successful crossing of the Blue Mountains and while at Bathurst undertook journeys of exploration which helped open up the Mudgee district. He had properties at Prospect, Bathurst, Mudgee and Springwood, was a magistrate and, later, a Member of the Legislative Council.

Thomas Shirley and Jane Jones appeared before the Bench for re-examination; when the latter received information that almst every article contained in her house was sworn to, and therefore directed that she should hold herself in readiness to answer for her offence before a Court of Criminal Jurisdiction. Shirley made overtures of becoming Evidence for the Crown, whereupon his examination was deferred until the other business of the day was gone through.

Thomas Shirley indicted for stealing a bag and quantity of sugar from a warehouse belonging to Simeon Lord in whose service he lived as Ostler. He called several witnesses but was found guilty and sentenced to 7 years transportation. Jane Jones was convicted of petty larceny and likewise received sentence of 7 years transportation.
